Every year, millions of people visit amusement parks and temporary carnivals seeking fun and the excitement provided by thrill rides. Unfortunately, numerous people are hurt during their stays at their amusement park of choice.

The Consumer Protection Safety Commission estimates that roughly 5,000 people are afflicted with an injury that requires a trip to the hospital on a yearly basis due to amusement park accidents. This number is just an estimate because it is impossible to know what the real number is. This is impossible because of the “rollercoaster loophole” in the Consumer Product Safety Act of 1991. In this act, the CPSC can regulate and inspect rides that move from place to place as much as it likes; however, it cannot regulate rides that are fixed to one spot. This means that at the majority of big amusement parks with big rides, the CPSC has no control over their safety.

There are a number of characters that can play a role in any accident on an amusement park ride. These causes fit into one of four categories: consumer behavior, operator behavior, mechanical failure, and design defects or limitations.

Consumer behavior causes accidents when a consumer does something that causes a ride to become unsafe. This can include intentionally rocking a car, standing up in a sitting ride, subverting the efforts of safety restraints, sitting improperly, and holding a child above the safety restraint.

Operator behavior is also capable of causing accidents. Operators cause injuries when they abruptly stop a ride, assemble the ride incorrectly, or don’t maintain the rides properly. Mechanical failure encompasses everything from a torn seat belt to serious structural issues. It includes missing safety pins, broken welds or structural components, exposed electrical wires, malfunctioning lap bars or other safety restraints, and a ride’s failure to shut off.

Some rides, even when everything else is working perfectly and everyone is behaving perfectly, still cause injuries. These rides are just dangerous due to design defects or limitations. They injure people while they appear to be working correctly without any unusual behavior.
