Duty to Warn

The duty to warn exists in a number of facets of tort law and personal injury. It is most commonly seen in property ownership but has other applications as well.

In property ownership, or premises liability, a property owner has a duty to warn individuals on the property of any known or possible hazards or dangerous that may be encountered. The duty to warn depends on the status of the individual guest or visitor. For example, a trespasser should expect a far lower standard of warning than a licensee or invited guest. This is because the licensee and invitee enjoy higher levels of respect from the law because they have actually been invited onto the property rather than merely deciding to step foot on it.

Another area where a duty to warn plays a role is in clinical psychology and or psychiatry. These areas require a duty to warn, breaching standard patient confidentiality rules, in the event that the patient reveals that he or she is planning on hurting him or herself or another person. This is required to prevent injuries to both the patient and the patient’s target.

Sometimes, a person breaches his or her duty to warn. When this occurs, an individual is at fault, whether that individual is a psychologist, a psychiatrist, or a property owner. The purpose of requiring people to warn others of a hazard is to give them an opportunity to avoid the hazard and remain unharmed or uninjured.
