Four Loko maker sued for wrongful death

The maker of Four Loko beverages, Phusion Projects, was recently sued for wrongful death.  Phusion Projects has faced criticism from the Food and Drug Administration and many others for producing highly caffeinated, alcoholic beverages.  The lawsuit claims that Phusion Projects markets Four Lokos towards young adults and underage drinkers.

The suit was filed on behalf of a 15-year old boy who was killed in the fall of 2010 after drinking two Four Loko drinks.  The boy was somehow able to purchase two of the alcoholic beverages at a convenience store and later drank them at a concert.  Officials from the concert venue were forced to call the teen’s mother to pick him up after he began behaving “erratically and agitated.”  The high caffeine content in the beverages desensitizes consumers to the affects of alcohol, making them especially dangerous.

On the way home, the boy jumped out of the car and took off running.  He continued running into a highway with heavy traffic, fell down, and was struck by a car.  The next day the 15-year old passed away.
