Mother files wrongful death suit against prison

A mother living in Miami-Dade County has filed suit against Northwest Florida Reception Center over her 44-year old son’s death.  The woman’s son was an inmate at the facility when he experienced an asthma attack and died in June 2010.

According to the wrongful death lawsuit, guards at the prison caused the man’s death by spraying him with a chemical that exacerbated his asthma.  On the day of his death, the man experienced an asthma attack in the morning and had to be treated by medical professionals at the jail.  Later in the day, guards felt they needed to punish him for yelling from his cell and they sprayed the chemical on him twice.  30 minutes later, the man was not breathing.

Corrections officers at the prison knew about the man’s asthma, but sprayed him with the agent multiple times anyways.  Department of Corrections regulations prohibit officers from using chemicals on inmates with medical conditions like asthma in situations that are not emergencies.
