Hit-and-Run Accident Reported in Lakeline

Law enforcement authorities in Lakeline, Florida reported that a hit-an-run accident occurred at 7:30 a.m. this morning on Winter Lake road at Reynolds road. Following the accident, the roads remained open and authorities have not yet released details about the incident. The accident was one of two reported traffic incidents in Lakeline this morning. Authorities have not released information about any of the victims or injuries sustained in the collisions.

Self-Defense: Legal Considerations

When you are attacked and feel as though you or your loved one may be in danger, it is an extremely frightening experience. Compounding the fear and anxiety are the numerous questions and confusion surrounding the legality of self defense: if you defend yourself, will you find yourself on the receiving end of a lawsuit when everything is said and done? Furthermore, will that let the attacker claim that he was acting in self defense?

The key determining factor in the use of self defense is whether or not force was reasonably necessary in order to prevent injury. The inherent problem with this definition is that it is very subjective; different judges and juries have different definitions of what is considered “reasonably necessary”, making an objective standard elusive. Typically, this criterion involves determining exactly how much force was necessary to repel the attack; it precludes people from using deadly force to repel an otherwise non-deadly attack.

However, deadly force is acceptable to use if the victim reasonably believes that the attacker will cause serious injury or death to either the victim or a victim’s loved one. Again, this is a subjective criterion and may be subject to interpretation as to what exactly constitutes a “reasonable expectation” of injury. Furthermore, in many jurisdictions, the victim is required to reasonably attempt to flee before using deadly force to repel an attack.

Plane Crash Strikes House and Cuts it in Two

A twin engine Cessna took off from a Florida airport shortly before noon on Friday afternoon.  Minutes after take-off,  the plane began to run into trouble.  The plane came down and crashed into the ground.  In the process of crashing,  the plane struck a house in the middle,  cutting it into two separate pieces. The pilot of the Cessna was killed in the plane crash.

The house caught fire after the crash, and the owner reports that almost everything in the home is gone.  The owner also reports that injury was barely escaped as home was emptied minutes before impact.

Types of Toxic Torts

A toxic tort is essentially a product liability case; it is filed against the parties who are responsible for the manufacture and distribution of chemicals which have caused an injury. Most commonly, the chemicals responsible for these injuries are occupational chemicals, although occasionally pharmaceutical products may result in a toxic tort, as may environmental hazards.

Types of Toxic Torts

Occupational: If you are exposed to hazardous chemicals while at work, although you generally sign away your right to bring a lawsuit against your employer, you may still be able to file a toxic tort against the manufacturer or distributor of the chemical in question.  

Pharmaceutical: When a pharmaceutical product causes unreasonable and undocumented side effects, you may be able to bring a toxic tort against the pharmaceutical manufacturer. Although in most cases, the doctor has prescribed the medication in good faith, if the doctor was aware of potential side effects and failed to inform you, he or she may be liable as well.

Home and Environmental: If you are exposed to toxic chemicals at your home or through an environmental medium (such as the air or water), you may be able to file a toxic tort, possibly against a landlord, homebuilder, or seller who has not informed you of the danger, or the party responsible for the toxic chemicals.

Shaken Baby Syndrome

When we put our children into the hands of a caretaker, we trust them with the most valuable thing in our lives, and we expect them to uphold the highest level of responsibility. Although the common saying goes, “Never shake a baby”, sometimes, perhaps out of anger, frustration, stress, or out of a sheer lack of knowledge, a caretaker may shake a child. What can result from this is a set of symptoms called Shaken Baby Syndrome, often referred to as Abusive Head Trauma.

How does shaken baby syndrome occur? The anatomy of children, especially infants, makes them particularly vulnerable to head and neck injuries. The majority of shaken baby syndrome victims are between the ages of three and eight months, although injuries have been seen in children as old as four years old.

Because children’s neck muscles are not properly developed, they provide very little support for a baby’s head. When a baby is shaken, the muscles cannot properly prevent the head from whipping back and forth, and the brain is knocked around inside the baby’s skull. This can cause blood vessels to rupture, brain tissue to tear, and bleeding inside the skull, leading to severe neurological symptoms.

Motorcyclist Injured in Traffic Accident

A 62 year-old motorcycle rider from Mulberry is in critical condition following a motorcycle accident.

While stopped, the man was hit from behind by a 17 year-old.  The man was thrown from the motorcycle.  Emergency officials responded and took the man to St. Joseph's Hospital.

An investigation is on-going in to this accident.  Charges may be pressed against the 17 year-old driver.
