A toxic tort is essentially a product liability case; it is filed against the parties who are responsible for the manufacture and distribution of chemicals which have caused an injury. Most commonly, the chemicals responsible for these injuries are occupational chemicals, although occasionally pharmaceutical products may result in a toxic tort, as may environmental hazards.

Types of Toxic Torts

Occupational: If you are exposed to hazardous chemicals while at work, although you generally sign away your right to bring a lawsuit against your employer, you may still be able to file a toxic tort against the manufacturer or distributor of the chemical in question.  

Pharmaceutical: When a pharmaceutical product causes unreasonable and undocumented side effects, you may be able to bring a toxic tort against the pharmaceutical manufacturer. Although in most cases, the doctor has prescribed the medication in good faith, if the doctor was aware of potential side effects and failed to inform you, he or she may be liable as well.

Home and Environmental: If you are exposed to toxic chemicals at your home or through an environmental medium (such as the air or water), you may be able to file a toxic tort, possibly against a landlord, homebuilder, or seller who has not informed you of the danger, or the party responsible for the toxic chemicals.
